Dear Members
As we are all aware the unions (Cosatu & Nactu), have not moved on their position regarding the banning of temporary employment services (TES)/labour brokers. The process at Nedlac has reached deadlock on this issue, with Nedlac declaring the matter considered in terms of S77(1)(c) .
Yesterday Cosatu issued a strike notice regarding the issue of labour brokers as well as E-Tolling. The strike is to take place countrywide on the 7 March 2012.
As business we have fully participated in the Nedlac process, conceding on many points as business and moving from our original positions. You will see in the documents attached herewith that there are matters that we have agreed to as business. However, labour has not shown the same courtesy and there are fundamental issues that they refuse to budge on, one of which being the TES/ labour broking issue.
The impact if the Minister goes ahead and passes these Bills is severe for us as an Industry. It will lead to serious job losses and possibly closure of many smaller businesses who are already experiencing trading and liquidity challenges.
I would like to get your feedback on your views on this matter. Ideally the employment forum meeting should be dealing with this but it is only scheduled to take place on the 16 April 2012. I am happy to set up an earlier urgent meeting should members wish to meet to discuss this matter further in the forum. Please advise.
We are currently in the process of trying to secure a meeting with the Minister of Labour to raise these issues and our concerns as an industry and need a full mandate from the members. We are also getting media queries on our stance as an Industry and are not in a position to comment as we do not have your views on the matter.
